【Opinion: Trump Suggests He May Choose SEC Chairman Through 'Recess Appointment' To Bypass Confirmation Process】 November 13th, Trump Recently Stated That Only He Has The Authority To Choose Which U.S. Senator Will Begin Serving As The Senate Majority Leader From January 2025 When The New Congress Is Sworn In. He Is Hoping The Potential Majority Leader Will Agree To A Recess Appointment To Bypass The Confirmation Process, Allowing Officials To Assume Authoritative Positions "immediately" Rather Than Abiding By The U.S. Constitution, Which Grants The President "the Authority To Fill All Vacancies That May Occur During The Recess Of The Senate By Granting Commissions Which Shall Expire At The End Of Their Next Session." This Also Appears To Include Replacing SEC Chairman Gary Gensler. During His First Term, This Power Allowed Trump To Appoint Individuals Who May Not Have Received Senate Approval. Recess Appointments Are Intended To Be Temporary And Not A Substitute For Senate Approval.U.S. President Biden Nominated Gensler To The SEC In 2021, And The Senate Approved The Appointment With 54 Votes To 45, With A Term Extending Until June 2026. During Trump's First Term, He Went Through The Constitutional Process Of Appointing SEC Commissioners But Also Attempted To Bypass A Senate Controlled By Republicans By Making Appointments During Recess To The U.S. Attorney General.It Is Currently Unclear Whether Trump's Nominee For SEC Chairman Will Receive Enough Votes For Senate Confirmation Or If He Intends To Formally Nominate Anyone For Any Position, Relying Solely On Recess Appointments.
